Privacy Notice on the Protection and Processing of Personal Data

1. Data Controller

Pursuant to Law No. 6698 on the Protection of Personal Data (“KVKK”), your personal data may be processed by Korgün Software (“Korgün” or the “Company”), acting as the data controller, within the scope described below.

2. Personal Data Processed and Purposes of Processing

Your personal data collected through digital forms, such as demo requests, newsletter subscriptions and contact forms on our website (korgun.com.tr) and its extensions, cookies or other electronic methods comprises identity information (first and last name), contact information (email address, telephone number and province) and professional experience information (company name and job title), and is processed only to the extent necessary and proportionate for the purposes set out below:

• Fulfilling Service Requests: Providing information about the products and services you request, scheduling and conducting demonstrations, preparing quotations and contacting you for these purposes.
• Communications: Responding to your questions, requests and feedback.
• Marketing and Promotional Activities: Conducting promotional, newsletter, campaign and marketing activities relating to our products and services if you have given explicit consent to receive commercial electronic communications.
• Improving Service Quality: Improving our services, analyzing user experience and carrying out statistical studies for these purposes.
• Fulfilling Legal Obligations: Ensuring that our activities comply with applicable legislation and providing information to authorized persons, institutions and organizations.

3. Transfer of Personal Data

To fulfill the purposes stated above and subject to the personal data processing conditions set out in Articles 8 and 9 of the KVKK, your personal data may be transferred to our domestic or overseas business partners from whom we obtain services (such as CRM infrastructure, bulk email services and cloud computing providers), our suppliers, legally authorized public institutions and private persons.

4. Method and Legal Basis for Collecting Personal Data

Your personal data is collected by wholly or partly automated means when you complete forms on our website or use the website (through cookies). This data is processed on the following legal grounds set out in Article 5 of the KVKK: “being directly related to the establishment or performance of a contract”, “being necessary for the data controller to fulfill a legal obligation”, “processing being necessary for the legitimate interests of the data controller, provided that the data subject’s fundamental rights and freedoms are not harmed” and, for activities such as sending commercial electronic communications, your “explicit consent” .

5. Rights of the Data Subject (Article 11 of the KVKK)

As a data subject, you have the following rights under Article 11 of the KVKK:

• To learn whether your personal data is being processed,
• To request information if your personal data has been processed,
• To learn the purpose of processing your personal data and whether it is used in accordance with that purpose,
• To know the third parties to whom your personal data is transferred within Türkiye or abroad,
• To request correction of your personal data if it has been processed incompletely or inaccurately,
• To request the erasure or destruction of your personal data when the reasons requiring its processing cease to exist, even if it was processed in accordance with the KVKK and other applicable laws,
• To request that third parties to whom your personal data has been transferred be notified of its correction, erasure or destruction,
• To object to a result detrimental to you arising from analysis of your processed data exclusively through automated systems,
• To claim compensation for damage suffered as a result of unlawful processing of your personal data.
